Lawsuit Alleges Serious Defects
The allegations against AS America Inc. center around the flush valve seal – a device that keeps the flushing mechanism operational and prevents water from leaking out of the tank – on the Champion 4 toilet was defectively designed and manufactured. As a result of the defects, a blister can develop on the surface of the flush valve seal after minimal use.
As the blister develops and creates a leak path, substantial leaks will develop and cause water to seep out of the tank. The potential defect may also alter the normal function of the Champion toilet, and may cause leaks so large the toilet can flush on its own.
Despite being aware of the defect, AS America has failed to fully address and fix the flush valve seal design. The defect should be covered by AS America’s 10-year express warranty offered on Champion toilets.
