Workplace Injuries

Myth:  People who are injured on the job are limited to worker's compensation.

Fact:  When you are injured on the job, you may have the right to pursue additional compensation outside of the worker's compensation system.

If a negligent person who is not your co-employee injures you while working, you can bring a lawsuit against that person for additional compensation. If a defective product injures you at your place of work, you can pursue the negligent manufacturer of the product for additional compensation, even if you are receiving payments for your injuries from worker's compensation. Finally, if you are injured because your employer removed a safety device on a machine, or required you to work in a dangerous situation, you may pursue your employer for additional compensation, even if you are receiving worker's compensation benefits.
