Ruling Allows Re-Trial of Suit Against Toledo Hospital 

Cleveland, Ohio - March 20, 2012 -- The law offices of Spangenberg Shibley & Liber LLP are pleased to announce a recent ruling that will allow them to pursue a medical claim against Toledo Hospital.

The facts of the case are clear. The firm's client, Gary Tisdale, was admitted to the hospital for abdominal surgery in 2002. His physicians ordered staff to apply external pressure leg cuffs post-surgery to prevent deep vein thrombosis, a condition where blood clots form in a deep vein, most commonly in the legs. Unfortunately, hospital staff failed to apply the external pressure cuffs and, as a result, a clot formed, dislodged and caused a pulmonary embolism. Surgeons acted quickly to remove the clot from Mr. Tisdale's lungs, but not before he suffered blindness and brain damage. He sued Toledo Hospital for his injuries. Read More

Ohio Man Settles with Spinal Surgeon & Medical Center for Perforation of Bowels During Back Surgery
An Ohio man has recently settled a suit against an Akron spine surgeon for injuries he sustained during a back surgery performed to help alleviate pain in his lower back and right lower extremity.

According to the complaint filed in the Court of Common Pleas, Summit County, Ohio, the doctor performed a dangerous lumbar fusion procedure on the patient without adequately warning him of all the risks. The procedure, called Axial Lumbar Interbody Fusion, carries with it the risk of bowel perforation; a risk that the doctor failed to fully inform the patient of, as stated in the complaint. Ohio Woman Reaches Lawsuit Settlement of Post-Surgical Complications Resulting from Hospital Negligence
An Ohio woman and her husband recently settled a lawsuit against a Toledo area hospital for injuries suffered in a post-surgery fall soon after undergoing a knee arthroplasty procedure at said hospital. The fall led to an array of physical complications for the woman, who almost needed to amputate her leg to survive post-surgery complications stemming from the accident.

Over $15 Million Awarded to an Ohio family for fatal trucking accident
Cleveland, Ohio -  March 9, 2011 -- Federal District Judge Theresa Springmann ordered the Net Trucking Company to pay the Karpov family more than $15 million in compensatory and punitive damages for a multiple fatality crash caused by its driver. Net Trucking was found liable for allowing one of its truck drivers to drive more hours than legally allowed and for knowingly permitting the driver to alter his driving log books to cover up the violation. The Net Trucking driver that caused the crash was also under the influence of alcohol at the time of the crash.

Cleveland Law Firm Files Class Action Suit Against Akron's FirstMerit Bank
Cleveland, Ohio - December 13th, 2010 -- Ohio based law firm, Spangenberg Shibley & Liber filed a class action lawsuit case against FirstMerit Bank. The suit alleges that FirstMerit deliberately and systematically reordered debit transactions from highest to lowest regardless of the actual order the transactions occurred. This resulted in higher overdraft fee recoveries for FirstMerit against its customers. This conduct violated the customer banking agreement and ohio law. The suit requests an injunction stopping FirstMerit from improper conduct in the future and the recovery of fees, with interest, that were wrongfully charged by FirstMerit to its customers.

Hysterectomy Surgery Complications Results in Bladder Injury

December 12, 2008 -- The 6th District Court of Appeals of Ohio recently reversed a medical malpractice jury verdict for the defendant finding that the trial court abused its discretion and caused prejudicial error when it refused to excuse a prospective juror who the plaintiff argued could not be fair and impartial because of her relationship with the defendant Hospital, the defendant doctor, and a physician-witness who had been dismissed as a defendant in the case before trial.

Wrongful Shooting Lawsuit Filed On Behalf of 37 Year Quadriplegic
On December 10, 2008 the lawyers at SS&L filed suit in federal court in West Virginia against the Sheriff of Hancock County on behalf of Charles Penson... a 37-year old Ohioan who was shot multiple times in the neck and back rendering him permanently quadriplegic.

Recent Coumadin Cases in the News
Spangenberg partners, Rhonda Baker Debevec and Stuart Scott, recently handled two separate malpractice cases for clients who suffered severe bleeding complications related to a commonly prescribed anti-coagulant or "blood-thinner" called Coumadin. This medication - also sometimes called Warfarin - is prescribed for medical conditions that increase the patient's risk for forming potentially fatal blood clots like atrial fibrillation (an abnormal heart rhythm) and deep vein thrombosis (DVT). By inhibiting the blood's complex clotting or coagulation mechanism, Coumadin prevents the formation of new clots and the growth or extension of old clots.
